TERMS OF SERVICE
We believe in building relationships with our clients based on mutual trust and respect. By asking Minted Design Co. to undertake a design project, or accepting a quote from Minted Design Co. (via email, verbally or accepting through our quoting system), you agree to the following terms and conditions. If you have any questions regarding these terms please get in touch to discuss before we start your project.
Communication
The best way to contact us is via email, and we aim to get a response to you ASAP. This enables us to track quotes, briefs and changes as well as preventing phone calls from interrupting our creative process, creating better outcomes for everyone. Please don’t be offended if we are unable to answer the phone when you call - you are welcome to leave a message and we will get back to you as soon as we can!
Please also note that we have incredibly limited meeting times available, and these may be charged for, including travel time if necessary, if a meeting is required.
If Minted Design Co. receives no communication from you, the client over a 3 week period in regards to a project, the work done to date on the project to date will be billed out.
Quotes
Quotes are valid for 30 days, after which time a new quote may be required. Any alterations, additions or variations outside of what is outlined in the quote will be charged at our hourly rate.
Payment
Invoices are sent shortly after completion of design jobs and must be paid on or before the 20th of the month following via bank transfer. A statement will be sent at the start of the month following. Please pay your bills on time. If you don’t we reserve the right to charge interest on any amounts outstanding. As a last resort, should we need to pass on the debt to a collection agency you will be liable for all fees.
For projects over $1000, a deposit may be required before work commences and / or progress payments as the work progresses. These will be clearly outlined before the project is undertaken.
Additional Costs
There may be additional costs incurred above the design quote in order to complete the project, such as the purchase of stock images, fonts and printing. These will be outlined to you for approval before being purchased.
Changes and Revisions
Are limited to a maximum of 3 rounds and must be completed within 3 weeks of the start date of the project. If these aren’t completed within the 3 week period, we reserve the right to charge out work to date. Anything outside of this as well as any change in the project scope or requests for new concepts will be charged hourly.
Artwork Approval
While we take every care we can – at the end of the day we’re only human. We are not liable for any errors or omissions of any kind once a design has been approved by you.
Design Ownership
Upon completion of and payment of the project in full, Minted Design Co. transfers all rights and ownership of custom designs to the client. This includes the final PDF, jpg etc files as determined by the project, but excludes the working files. Any unused concepts/design elements remain the property of Minted Design Co.
Software and third party graphics or programs are not transferred to the client, and remain under copyright of their respective owners or publishers.
We reserve the right to feature your completed design project in our website portfolio, marketing materials and on our social media accounts, unless agreed otherwise by both parties. All websites designed by us will also have a small Design by Minted Design Co credit in the footer of their website that cannot be removed, unless agreed otherwise by both parties.
Sub-Contractors
We reserve the right to hire subcontractors on any project should the need arise.
Colour Variation
With all colours there will be variations between what you see on screen (RGB) and what you see in print (usually CMYK). These can vary between printers, stocks and print-runs – colour variation is simply inherent in the printing process. Because of this we accept no responsibility for any colour variation.
Cancellation of Projects
While we hope we can always work things out, if the relationship or design work is deemed unsatisfactory by either party the project may be cancelled. Cancellation must be received in writing, and the time spent on the design project by Minted Design Co. to that point will be billable. If the project is cancelled, all design work remains the property of Minted Design Co.
Liability
Services purchased from Minted Design Co are provided "as is" without warranty of any kind that the project will be error free. In no event shall Minted Design Co. be liable to the client for any direct, indirect, special, punitive, incidental, or consequential damages arising out of the use of their website, graphic design services, and/or goods provided to the client. This includes, without limitation, lost profits, business interruption, loss of data or other losses directly resulting from the use of the website, services, and/or goods provided to the client. The entire risk as to the quality and performance of the graphic design or website design project is with the client.
Websites
Our websites are built and designed on the Rocketspark system, with hosting, emails (if required) and domain name purchases payable directly to Rocketspark. Rocketspark's terms and conditions are viewable here
You, the client are responsible for the accuracy of content and information on your website. It is also your responsibility to ensure that forms, third-party plugins etc are working correctly. We accept no responsibility or liability for errors in your website content. We recommend you inform us of any errors as soon as they are found.
Some features, functionality and design that may be outside the Rocketspark system capabilities may incur extra development costs. These will be quoted to you as they are identified in the project and won't be progressed until you have approved the additional costs.
Please note that we make no guarantees as to where any SEO implemented for you will rank your website in Google.
Minted Design Co. reserves the right to change or update these terms at any time without prior notice.
